What is the difference between a will and a faraid distribution?
A will under the Wills Act 1959 applies to non-Muslim estates and allows the testator to direct how assets are distributed. For Muslims, faraid governs the compulsory shares of heirs as prescribed under syariah law, and a will can only direct the one-third portion not covered by faraid. An estate planning consultation will clarify which framework applies to your circumstances.
How long does probate administration typically take in Penang?
Timelines vary depending on estate complexity, whether a will exists, and court scheduling. A straightforward estate with a valid will may be administered within six to twelve months. More complex matters, or those that involve multiple asset classes or disputed elements, may take longer. We provide realistic timelines at the outset and update the family at each significant stage.
Can a dispute over a will be resolved without going to court?
Many inheritance disputes are resolved through negotiation or mediation before any hearing takes place. Where the parties retain a genuine interest in preserving family relationships, we prefer to explore these routes first. What documents should I bring to an estate planning consultation?

Are your fees fixed or based on a percentage of the estate?
Our fee structures vary by service. Estate planning consultations are charged at a fixed rate. Probate administration and dispute resolution matters are quoted before engagement commences, taking into account estate complexity and anticipated work scope. We follow the Solicitors' Remuneration Order where applicable, and any departures from that are explained clearly.
Can I plan for property held jointly with my spouse?
Yes. Jointly held property passes by survivorship to the surviving co-owner unless otherwise structured. Estate planning allows you to consider whether that default outcome aligns with your family's wishes and, where it does not, to put in place appropriate instruments. We encourage couples to attend estate planning consultations together where possible.
