Terms & Conditions

1. About These Terms
These Terms and Conditions ("Terms") set out the basis on which Waris Mulia ("the Firm", "we", "us") provides legal services and makes its website at warismul available for use. By engaging our services or using our website, you confirm that you have read and agree to these Terms.
These Terms are governed by the laws of Malaysia, including the Legal Profession Act 1976, the Contracts Act 1950, and applicable provisions of the Personal Data Protection Act 2010.
2. Our Practice
Waris Mulia is a legal practice registered in Malaysia and operating from Lebuh Light, 10200 George Town, Penang. Our lawyers are members of the Malaysian Bar. The Firm specialises in inheritance law, estate planning, probate administration, and the resolution of contested estate matters.
Nothing on this website constitutes legal advice. The information provided is for general reference only. A formal solicitor-client relationship is established only when both parties have signed an engagement letter and the Firm has confirmed acceptance of the matter.
3. Engagement of Services
When you instruct the Firm to act on your behalf:
- We will issue a Letter of Engagement setting out the scope of work, fees, and payment terms.
- The engagement does not commence until the Letter of Engagement has been accepted by you in writing.
- We reserve the right to decline to act in any matter, including where a conflict of interest exists or where the matter falls outside our areas of practice.
- Each matter is assigned to a named lawyer who takes responsibility for the file.
4. Fees and Billing
Our published fees for consultations and standard services are set out on our website and in our service descriptions. These serve as a guide; the fee for your matter will be confirmed in the Letter of Engagement.
- Estate Planning Consultation: RM 270 for an initial planning meeting including a written planning note.
- Probate Administration and Transfer: From RM 820, subject to the complexity of the estate and the number of assets and institutions involved.
- Dispute Resolution for Inheritance Matters: From RM 3,540, with further fees dependent on the extent of proceedings and hearing attendance required.
Where a matter is expected to involve additional disbursements — such as court filing fees, stamp duty, or searches — these will be disclosed in advance. Disbursements are billed at cost and are separate from professional fees.
Invoices are payable within 14 days of issue unless otherwise agreed. Late payment may result in a suspension of work on your file.
5. Confidentiality and Legal Professional Privilege
All communications between you and the Firm in the course of an engagement are protected by solicitor-client privilege under Malaysian law. We will not disclose the contents of your file to any third party without your written consent, except where we are required to do so by law or court order.
This duty of confidentiality continues after the conclusion of the matter and after any termination of the engagement.
6. Your Responsibilities
To enable us to act effectively on your behalf, you agree to:
- Provide accurate and complete information relating to the matter when requested.
- Inform us promptly of any changes in circumstances that may affect the matter or the instructions given.
- Respond to requests for instructions or documents within a reasonable time.
- Not request or instruct us to act in a manner that would place us in breach of our professional obligations or Malaysian law.
Where delays arise because of late instructions or incomplete information provided by you, the Firm will not be responsible for any consequences of those delays.
7. Limitation of Liability
The Firm's liability to you in connection with any matter is limited to the amount of professional fees paid to the Firm in respect of that matter, except where liability cannot be limited by law (for example, in cases involving personal injury or fraud).
We accept no liability for losses arising from your reliance on general information published on this website, as that information does not constitute legal advice and is not a substitute for formal engagement.
8. Termination
Either party may bring an engagement to an end with reasonable written notice. If you terminate the engagement, we are entitled to invoice for all work completed up to the date of termination. If the Firm terminates the engagement, we will provide you with reasonable time to arrange alternative representation and will return all original documents held on your behalf.
The Firm reserves the right to cease acting where instructions are withdrawn, where fees remain unpaid after notice, or where continuing would place us in conflict with our professional obligations.
9. Complaints
We are committed to maintaining a high standard of service. If you are dissatisfied with any aspect of our work, please write to us at [email protected] or address your letter to the managing lawyer at our George Town office. We will acknowledge your complaint within 5 working days and aim to provide a substantive response within 21 days.
If a matter remains unresolved, you may refer it to the Malaysian Bar's Disciplinary Board in accordance with the Legal Profession Act 1976.
10. Intellectual Property
All content on this website — including text, design, layout, and graphics — belongs to Waris Mulia or its content contributors. You may access and print pages for personal, non-commercial use. You may not reproduce, republish, or distribute website content without our written permission.
11. External Links
This website may include links to external resources such as the Malaysian Bar, the Land Registry, or relevant government portals. We provide these links for convenience and do not endorse or take responsibility for the content of those external sites.
12. Changes to These Terms
We may revise these Terms from time to time. The current version will always be available on this page with the date of last update. Continued use of our website following a revision constitutes acceptance of the updated Terms. Where a revision materially affects an ongoing engagement, we will notify you directly.
13. Governing Law and Jurisdiction
These Terms, and any dispute arising from them, are governed by the laws of Malaysia. The parties agree to submit to the non-exclusive jurisdiction of the courts of Malaysia for the resolution of any dispute.
