Estate Planning George Town, 2024

Challenge

An elderly couple held property registered in the husband's name alone, had EPF accounts with outdated nominations, and had never discussed what should happen to a family business interest. Their two adult children held different views about the family's assets.

Approach

A joint estate planning consultation was held with both spouses and a separate session with each adult child to understand their expectations. Asset mapping identified gaps in nominations. The planning note set out three possible structures for the couple to consider over two weeks.

Outcome

New wills executed for both spouses, EPF nominations updated, and a testamentary trust structure drafted for the business interest with agreed succession terms. Family reached consensus before any drafting began.

Probate Penang, 2024–2025

Challenge

A widow needed to administer her late husband's estate, which included three properties in Penang, two bank accounts, a unit trust portfolio, and a share of a Kedah-based land holding. No will existed. Four adult children were beneficiaries.

Approach

Letters of administration obtained through Penang High Court. Each asset class was handled through the appropriate authority — land registry for properties, Amanah Raya for smaller balances, direct bank liaison for accounts. The Kedah land was coordinated with a correspondent firm.

Outcome

Estate fully administered and distributed within 14 months. All four beneficiaries received their shares with a final written distribution account. The widow received assistance in updating her own estate documents following completion.

Dispute Penang, 2024

Challenge

One of three siblings disputed a will that left the family home entirely to the eldest sibling. The disputing party alleged that the testator lacked capacity at the time of signing and that the will had been executed under pressure.

Approach

File review identified that medical records from the relevant period were available and would likely support the will's validity. The opposing party was invited to a mediation session before any court proceedings were commenced.

Outcome

A negotiated arrangement reached in mediation — the eldest sibling retained the property but agreed to a financial adjustment to the other two. No court hearing was required. All three siblings attended their father's subsequent memorial occasion together.
